Copyright and DMCA Policy
1. What this document covers
Trooth respects the intellectual property of others and expects the same of the companies and people who use the Service. This policy describes how to report content on the Trooth Network that you believe infringes your copyright, what Trooth does with such reports, and how a counter-notice works. It supplements the Terms of Service and the Acceptable Use Policy. Complaints that are not about copyright, such as a factual error on a company page, belong under the Publication, Correction and Right-of-Reply Policy instead.
2. Reporting claimed infringement
To report claimed copyright infringement, send a written notice to legal@trooth.co with the subject line "DMCA notice". Consistent withundefinedU.S.C. 512(c)(3), an effective notice includes:
- identification of the copyrighted work you claim is infringed, or a representative list if there are several
- identification of the material you claim is infringing, with enough information for us to locate it on the Service, ideally the exact URL
- your name, mailing address, telephone number and email address
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- your physical or electronic signature
Postal correspondence can be addressed to Trooth, LLC at the address published in the Impressum.
3. What Trooth does with a notice
Notices enter the same review pipeline the Acceptable Use Policy describes. If we remove or disable access to material in response to a notice, we make reasonable efforts to notify the person who provided the material, and we record the notice. An incomplete notice may be answered with a request for the missing elements rather than action.
4. Counter-notice
If material you provided was removed and you believe that was a mistake or misidentification, you may send a counter-notice to legal@trooth.co including:
- identification of the material that was removed and where it appeared before removal
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
- your name, mailing address and telephone number
- a statement that you consent to the jurisdiction of the federal district court for your address, or if outside the United States, for any judicial district in which Trooth may be found, and that you will accept service of process from the person who filed the original notice or their agent
- your physical or electronic signature
If we receive a valid counter-notice, we may forward it to the original complainant and, unless they inform us they have filed a court action, restore the material within a reasonable period consistent with the statute.
5. Repeat infringers
Trooth may suspend or terminate the accounts of users who are determined to be repeat infringers.
6. Misrepresentation
UnderundefinedU.S.C. 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Do not use this process to attack accurate content about your company; that is what the correction process is for.
