Law Enforcement and Government Request Guidelines
1. What this document covers
These guidelines describe how Trooth, LLC responds to requests from law enforcement and government agencies for information about the Service and its users. They exist so that requests are handled consistently, lawfully and with respect for the people whose data is requested. They are operational guidelines, not a contract, and they do not create rights for any party.
2. What Trooth holds
Trooth is a business trust platform, not a communications service. The data Trooth holds is described in the Privacy Policy, and how long each kind is kept is described in the Data Retention Summary. In broad terms: account and workspace records, company profiles and their witnessed evidence, buyer requests and reviews, billing records held by our payment processor, and operational logs. Much of a company's profile is already public on the Network. Trooth does not operate email, messaging or voice services for its users and holds no such communications content.
3. How to serve a request
Requests should be directed to legal@trooth.co. Include the legal basis for the request, the specific accounts or records sought, and a means of verifying that the request comes from the issuing agency. Requests should be narrow: Trooth reads every request for specificity and may ask an agency to narrow one that is overbroad.
4. What Trooth requires
Trooth requires valid legal process appropriate to the data sought under applicable law before disclosing non-public user information. Trooth reviews each request for facial validity, scope and jurisdiction, and may object to, or seek to narrow, process that appears defective or overbroad. Nothing in these guidelines commits Trooth to disclose information without process that applicable law requires.
5. Notice to affected users
Trooth's policy is to notify an affected customer of a request for their data before disclosure, unless notice is prohibited by law or court order, or Trooth believes in good faith that notice would create a risk of harm to a person or of destruction of evidence. Where a prohibition on notice expires, Trooth may provide notice after it does.
6. Emergency requests
If an agency believes in good faith that disclosure without delay is necessary to prevent death or serious physical injury, it may submit an emergency request to legal@trooth.co with "Emergency" in the subject, describing the emergency and the specific information needed and why. Trooth evaluates emergency requests case by case, consistent with applicable law.
7. Requests from outside the United States
Trooth, LLC is a United States company. Agencies outside the United States should proceed through a mutual legal assistance treaty, letters rogatory, or another mechanism recognized under applicable law.
8. Preservation
On receipt of a valid preservation request, Trooth will take reasonable steps to preserve the identified records for the period applicable law provides, without disclosing them. Preservation is not disclosure.
9. Reimbursement
Where applicable law permits, Trooth may seek reimbursement for the costs of responding to legal process.
